SC’s observation regarding Article 370 is a welcome assurance to our people, says Mehbooba

Srinagar: Chief Minister of Jammu and Kashmir has welcomed the Supreme Court’s observation that Article 370 is not a temporary provision.

Mehbooba in a tweet said that apart from the territorial integrity,  the Article plays a bigger role safeguarding the religious, cultural & linguistic integrity of our state.

The Supreme Court on Wednesday said that Article 370 of the Constitution which gives special status to Jammu and Kashmir is not a temporary provision.

The apex court said that in its earlier verdict of 2017 in the SARFESI case, it has been already held that Article 370 was “not a temporary provision”.

“The issue concerned is covered by the judgement of this court in the 2017 SARFAESI matter, where we have held that despite the headnote of Article 370, it is not a temporary provision,” a bench of justices A K Goel and R F Nariman said.

The BJP unit of the Jammu and Kashmir recently said that the Article is being held back ‘temporarily’ and will be abrogated finally.

While speaking to Greater Kashmir, State BJP General Secretary Ashok Kaul said, “We will finally abrogate it. The statement by the minister in parliament is for the time being only and for the larger interest. Abrogation of Article 370 is one of the basic goals of our party.”

Earlier, while  replying to a written question by BJP MP Ashwini Kumar, who asked whether the government was committed to scrapping Article 370 of the Constitution.

“There is currently no such proposal under consideration of the government,” MoS for Home Ahir said.
