GoI clears ordinance, Triple Talaq now an offence

The government of India has declared triple Talaq to be an offence, clearing an executive order to enforce the law which had earlier not been passed back in August. Triple Talaq is the act of Muslim men getting an instant divorce by citing the word ‘talaq’ twice.

The law, which has been passed, now terms triple talaq to be an offence with a jail term of up to three years and a fine, while the woman will be guaranteed maintenance.

The new version states that the complaint can only be filed by either the woman or her family. The government of India further clarified that even neighbours could file complaints.

If the husband is ready for a compromise, the woman can drop her charges. There is also a possibility of bail which he judge can decide after hearing the wife’s side.

The police won’t be able to grant a bail while the magistrate can. The non-bailable provision has been retained as a deterrent. The law also addresses ‘nikah halala’, which requires the divorced woman to marry someone else and consummate the marriage if she wants to remarry her husband.

The changes brought about by the ordinance is tantamount to the upcoming 2019 Lok Sabha polls and the December state elections.
